Introduction
MIC'D UP CORP (“MIC'D UP,” “we,” “us” or “our”) respects your privacy and is committed to protecting it through this Privacy Policy in connection with our live, interactive, AI-moderated media and audience engagement platform through the MIC'D UP mobile app (the “App”) and our website located at http://micd-up.com/ (the “Website”) (collectively, the “Platform”).
This Privacy Policy (“Policy”) describes how we collect, use, disclose, retain, and protect information you provide to us or that we collect when you visit or use the Platform, and our practices for collecting, using, maintaining, protecting and disclosing that information.
This Policy applies to information that we collect:
- In connection with your access to and use of the Platform.
- In email, text and other electronic messages sent through or in connection with the Platform.
- When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.
This Policy does not apply to information collected by:
- Us offline or through any other means, including on any other website or application operated by us or any third party; or
- Any third party, including through any application marketplace (such as Google Play or Apple’s App Store) and any application or content that may link to or be accessible from or through the Platform.
Please read this Policy carefully to understand how your information is handled and the choices available to you. If you do not agree with our policies and practices, your choice is not to register for an account or use the Platform. By registering for an account or using the Platform, you agree to this Policy. This Policy may change from time to time. Your continued use of the Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
Information We Collect
We collect several types of information from and about users of the Platform, including information:
- By which users may be personally identified, such as their name, email address, username, profile information, and other identifiers by which users may be contacted online (“personal information”);
- That does not identify users, such as approximate geographic location, device information, IP address, browser type, operating system, session activity, internet connection information, equipment used to access the Platform, and general usage analytics; and
- Through user contributions that you publish or display (“posted”) on public areas of the Platform (“User Contributions”).
We may also collect audio, video, voice submissions, chat interactions, engagement metrics, and other content submitted through live or recorded broadcasts on the Platform.
Content you submit, publish, broadcast, or otherwise make available through the Platform may be visible to other users and participants. While we implement reasonable administrative, technical, and organizational safeguards, we cannot guarantee that content shared through the Platform will never be accessed, copied, redistributed, or misused by third parties.
We collect this information directly from you when you provide it to us, including:
- When interacting with the Platform, including filling in forms or registering for an account.
- In the form of records and copies of your correspondence (including email address), if you contact us.
Certain browsers offer “Do Not Track” signals. Because there is not yet a universally accepted standard for responding to these signals, the Platform currently does not respond to them.
We may use cookies, pixels, SDKs, analytics tools, and similar technologies to improve functionality, personalize user experiences, analyze Platform performance, and support security and fraud prevention efforts.
How We Use Information
We use information that we collect about you or that you provide to us, including any personal information:
- To present the Platform.
- To provide you with information, products or services that you request from us.
- To provide you with notices about your account or upcoming activity.
- To notify you about changes to the Platform.
- To fulfill any other purpose for which you provide it.
- In any other ways we may describe when you provide the information.
- For any other purpose with your consent.
- To operate, maintain, improve, personalize, and secure the Platform and related services.
- To moderate live and recorded content, including through automated and AI-assisted moderation systems.
- To analyze engagement, usage trends, audience participation, and Platform performance.
- To detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms or policies.
- To comply with legal obligations and enforce our rights and agreements.
Children’s Privacy
The Platform is not directed to children under the age of 13. However, we recognize that minors may access the Platform, and, in limited circumstances, information relating to minors may be collected. The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this section, “parents”) about our practices for collecting, using and disclosing personal information from children under a certain age (each a “child,” collectively “children”).
Certain content and features are only accessible by registered users, and we endeavor to limit our collection, use and disclosure of personal information to that of our registered users. However, anyone (including children) can access any of the publicly available parts of the Platform and any public content without providing us with their personal information. If you believe that we may have collected personal information from a child in a manner inconsistent with applicable law, please contact us at contact@micd-up.com.
Disclosure of Information
We may disclose aggregated information about our users without restriction.
We may disclose personal information collected as described in this Policy:
- To our business partners, employees, contractors, vendors, hosting providers, analytics providers, cloud service providers, moderation providers, and other service providers that support the Platform and our operations.
- To fulfill the purpose for which you provide it.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about users of the Platform is among the assets transferred.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
We do not currently sell personal information in exchange for monetary compensation. However, certain data sharing activities may be considered “sharing” under applicable privacy laws.
We may also disclose your personal information:
- To comply with any court order, law or legal process, including to respond to any government or regulatory request.
- To enforce any agreement(s) we have with you.
- If we believe disclosure is necessary or appropriate to protect the rights, property or safety of MIC'D UP, our users or others.
International Users
If you access the Platform from outside of the United States, information that we collect from or about you may be transferred out of your country of origin. By allowing us to collect personal information from or about you, you consent to such transfer and processing of your personal information in accordance with this Policy.
We recognize that several countries and regions in Europe, including the European Economic Area (“EEA”), have established strict protections regarding the handling of certain personal information that we may receive from users of the Platform in such countries and regions, including requirements to provide adequate protection of such information outside of such countries and regions. Where we collect personal information relating to individuals in such countries or regions, it may be processed and stored in the United States or other jurisdictions where we or our service providers operate.
Where required by applicable law, we implement reasonable safeguards designed to protect cross-border transfers of personal information.
Under European data protection law, in certain circumstances, you may have rights relating to access, correction, deletion, restriction, portability, and objection regarding your personal information. You can exercise any applicable rights by contacting us at legal@micd-up.com.
Accessing and Correcting Information
You may contact us at legal@micd-up.com to request access to or to correct any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Platform, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other users.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, disclosure, or destruction, including authentication controls, encryption, access restrictions, monitoring, and other reasonable security measures.
No method of electronic transmission or storage is completely secure.
Any transmission of information through the Platform is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.
Changes to This Policy
It is our policy to post any changes we make to this Policy on this page, with an updated “Last Updated” date at the top of this Policy.
You are responsible for maintaining a current and deliverable email address associated with your account, and for periodically accessing the Platform and visiting this Policy to check for any changes.
